By purchasing products from bayvape.ca, you are agreeing to be 19+ years of age or the age of local law to consume or possess Nicotine. All orders are shipped with signature and valid government ID required. You must be able to prove you are of legal age. If proof of age cannot be verified, bayvape.ca is not responsible for additional fees incurred for packages being returned to sender.
You also agree on the online store home page by clicking that you are in fact over 19 years of age. Please make sure all requirements are met as we can not and will not ship to anybody who is not of legal age. In store purchasing requires government issued photo ID of 19+ years or older. Online purchasing requires you are the age of local law to consume or possess Nicotine.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Bay Vape, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless Bay Vape and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Shipping & Handling
Here at Bay Vape, we ship Monday to Friday, excluding Holidays. We try to ship all orders that get placed prior to 1:00 PM EST the same day. All "IN STOCK" products are shipped within 24-72 hours during the business week. Back ordered products will be shipped once they arrive.
Shipping rates are calculated on the checkout page. A delivery estimate will be shown on the checkout page.

We offer free Expedited shipping on all orders in Canada over C$35.00 (before tax and after discounts) and free Small Packet USA Air shipping on all orders in the USA over C&75.00.
We reserve the right to cancel orders we deem unreasonable to ship for free (examples of this are extremely heavy or large and awkward products, etc). We will give you the option to pay for shipping on these items.
In the event your item is not successfully delivered due to an issue that we deem to be your fault (wrong address, failure to pick up), we will deduct the shipping fees from the initial shipment (even if it was free for you), and the fees for the return shipment that we were charged by the carrier from any potential refund you may be eligible to. Also, it will be subject to a minimum 5% credit card transaction fee and a $10 restocking fee.
If you need your package in a hurry we offer Xpresspost option for an additional fee.
Proof of Age Required
We utilize Canada Post's Proof of Age (18+ or 19+ depending on your province or territory) option on every single package, with no exceptions.
Because we utilize this option for all shipments, the signature will be obtained upon delivery of all shipments. If you are not home when delivery is attempted, the package will be left at your nearest post office, where you will have to show Proof of Age to sign and receive the package.
Any fees associated with packages that are Returned to Sender because Proof of Age was not able to be determined, will NOT receive a refund.
We can not remove this option, even if you have already been verified to be of age. Every package leaving our facilities will require to be age verified, in accordance with Canadian law. Only the person named in the "Shipping" fields can pick up the package. Canada Post will NOT release the package to anyone else.
Please do not place an order if you are not of age in your province of residence.
International Shipping:
At Bay Vape, we ship packages to many countries and we are working to expand more locations. Keep in mind we are unaware of your local laws and you, the customer assumes all shipping risks. Once the package leaves our hands, there is nothing we can do from that point. All international mail is shipped via Canada Post, the customs form will be labeled as exactly the same as your order. We will not stretch the truth or under declare values on any packages.
Customers are responsible for all customs and duty fees when importing products into their country. In certain cases, the packages may get held up in customs, or never delivered. We apologize for the inconvenience but international customers assume that risk, and once we ship it internationally we consider it a finalized sale.
International orders may be subject to import taxes and duty fees. The customer is responsible for paying these charges. We ship at your own risk, but there is a chance they WILL BE confiscated. We are not responsible for these products if done so.
Canada Post International Shipping may or may not be assigned a tracking number, depending on the shipping method you choose at the check out page. Your package will arrive in 5 - 21 business days, but because of potential customs delays, this process may take up to 30 business days. On average it takes approximately 9 business for international orders.
Order Processing
We process all in-stock orders 7 days a week (including Canadian holidays).
Please note, if you have received a tracking number during a weekend or major holiday, your order has been processed for shipment, but it is not picked up by Canada Post until the next business day.
We reserve the right to additional processing time if any questions or concerns regarding your order arise. We always do our best to get in touch with you via phone or email only when absolutely necessary. Please make sure you provide us with current contact information during checkout.
Typically, in-stock orders placed before 1:00 PM EST will go out the same day. Delivery will depend on the carrier.
For all orders with a billing name and address different to the shipping name and address, the customer must provide an ID that matches the billing name and address upon request via email. If failed to provide the requested ID, order(s) will be cancelled and refunded. When submitting ID for verification, please ensure the date of birth is readable.
Carrier Restrictions
Canada Post does not deliver packages on Saturday or Sunday, or on major Canadian holidays.
Tracking
Tracking numbers, if they are available, are automatically generated when we print your shipping label during order processing. An email containing the tracking number is then sent to the email address you provided during checkout. For international shipping, a tracking number may be not available based on the shipping method you choose.
Please check your email's "spam" folders if you did not receive a tracking number.
You may also find and view all tracking information directly by logging in to " My Account ".
Customers can track their packages using http://www.canadapost.ca.
It may take up to one business day to view your tracking number.
Lost & Undelivered Packages
Bay Vape is not responsible for delayed, miss-delivered or stolen packages. Once your order is scanned by Canada Post or any other delivery agents, it is under the sole care and control of Canada Post, or any other agents to safely deliver the package to the purchaser or assigned recipient as assigned to in the shipping address. Shipping is a service you purchase from Canada Post along with your order from us, so any shipping issues must be handled by Canada Post.
Bay Vape is not responsible for incorrect shipping information given by the purchaser. All packages returned to us due to a wrong address will be refunded minus 20% restocking fee and the original shipment cost, or reship after the customer paid for the cost to reship the order. We will not reship the order until it is returned to us by the courier.

Warranty & Returns
Returns & Exchange
Returns are accepted on products that are verified as Dead on Arrival (DOA) only. That means the products received were not functioning brand new out of the box.
All "Dead on Arrivals" (DOA), Damaged, Missing, or Wrong Item claims must be reported back to us within 48 hours from the time of delivery. Please inspect your items carefully upon receiving it, it is your responsibility to check within the time span and notify us of any problem.
If you would like to submit a request for refund or replacement, please contact us by email at sales@bayvape.ca. Please provide your FULL NAME, ORDER #, PHONE NUMBER, and REASON(S) for the return. You may be requested to provide pictures or video proof of the issue. If the return is approved, defective hardware must be shipped back to us at your expense in the manufacturer's original packaging. We will test the defective part and if confirmed defective, we will ship the replacement part and refund the shipping cost (an amount equal to our standard shipping cost to your location).
Unfortunately consumables are always a final sale (e-juice, pods/cartridges, coils, atomizers/tanks, accessories, drip tips, replacement parts, rebuildable supplies, disposable pod systems, rechargeable batteries, etc).
Regarding age restrictions, we utilize Canada Post's Proof of Age (18+ or 19+ depending on your province or territory) option on every single package, no exceptions. Any fees associated with packages that are Returned to Sender because Proof of Age was not able to be determined, will NOT receive a refund.
Refund Process
Refund may be issued back to the original payment (credit card, debit card, etc) or as store credit in the form of reward points. Bay Vape is not responsible for refunds to a Prepaid Card in the event the cardholder no longer has possession of.
Late or Missing Refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next, contact your bank. There is often some processing time before a refund is posted.

Cancellations
If you attempt to cancel an order before a shipping label has been printed, it will be subject to a minimum 5% credit card transaction fee and a $10 restocking fee. In some cases, such as confirmed underage purchases or refusing to prove your age with requested photo ID, you will not be eligible for a refund. Please see our TERMS OF SERVICE for more information.
NOTE: You cannot cancel your order once it has been submitted unless you first provide 2 pieces of government-issued photo ID by email or otherwise. BAYVAPE.CA must confirm that you are cancelling simply because of a change of heart, and not because you are an under-aged person, who illegally made a purchase on BAYVAPE.CA and fraudulently entered into a sales contract under false pretenses after verifying their age as “Legal Smoking ” upon entering the site.

SECTION 3 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
